Acceptance of Terms

By accessing or using the Atomic Boy Audio website, placing an order, downloading software, activating a license, creating a customer account, contacting support, or using any Atomic Boy Audio product or service, you agree to be bound by these Terms of Service.

If you do not agree to these Terms, do not access or use the website, products, software, downloads, licenses, or services.

Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction. If you are using our services on behalf of a company, organization, studio, or other entity, you represent that you have authority to bind that entity to these Terms.

Digital Products

Atomic Boy Audio sells digital audio products and related services, including audio plugins, standalone applications, installers, presets, license keys, product documentation, updates, and other downloadable content.

Unless specifically stated otherwise, no physical product will be shipped. Product images, descriptions, demonstrations, and feature lists are provided for general informational purposes.

Software License

A completed purchase grants you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the purchased software in accordance with these Terms and any product-specific license terms.

You may use the software in personal and commercial music, audio, video, broadcast, performance, and media projects, provided you do not distribute the software itself.

License Restrictions

You may not:

• Sell, sublicense, lend, rent, share, or redistribute the software.
• Share license keys, activation credentials, customer accounts, or download links.
• Reverse engineer, decompile, disassemble, or attempt to obtain source code.
• Bypass, disable, modify, or interfere with licensing or security systems.
• Remove copyright notices, branding, trademarks, or ownership information.
• Upload the software to file-sharing, torrent, warez, or unauthorized distribution services.

Customer Accounts

You are responsible for providing accurate account information and maintaining the confidentiality of your login credentials, email account, license keys, downloads, and activation information.

You are responsible for all activity that occurs through your account. Notify us promptly if you believe your account, license, or download access has been compromised.

Orders and Payments

Prices are displayed in United States dollars unless otherwise stated. Applicable taxes, currency conversion charges, and payment processing fees may be added during checkout.

We may refuse, review, limit, or cancel an order when we reasonably suspect fraud, pricing error, unauthorized payment activity, chargeback abuse, resale activity, or a violation of these Terms.

Digital Delivery

Digital products may be delivered through an order confirmation page, email, customer account, download link, license key, or another electronic delivery method after successful payment.

You are responsible for providing a valid email address and for checking spam, junk, and promotional folders when delivery emails are not immediately visible.

Refund Policy

Because digital products may be delivered or made accessible immediately after purchase, sales are generally final once a download, license key, activation, or other digital access has been provided.

A refund may be considered where required by law or when a verified technical issue prevents the product from functioning as advertised and our support team cannot provide a reasonable solution.

Compatibility and System Requirements

You are responsible for confirming that your computer, operating system, processor, digital audio workstation, plugin format, and other software meet the listed product requirements before purchasing.

We do not guarantee compatibility with unsupported operating systems, beta software, modified systems, unofficial host applications, or future versions of third-party software.

Activation and Licensing

Certain products may require a license key, device registration, account verification, online validation, or another activation method. Activation limits may apply.

License and activation systems may collect limited technical information necessary to verify authorized use, prevent unauthorized distribution, restore access, and provide support.

Updates and Support

We may provide updates, maintenance releases, bug fixes, feature changes, or compatibility improvements at our discretion.

We do not guarantee indefinite updates or support for every future operating system, processor, digital audio workstation, plugin format, hardware platform, or third-party service.

Acceptable Use

You agree not to:

• Use the website or services for unlawful, fraudulent, or abusive purposes.
• Attempt to gain unauthorized access to accounts, systems, servers, or data.
• Introduce malware, harmful code, automated attacks, or disruptive technology.

Intellectual Property

Purchasing a product does not transfer ownership of the software or any intellectual property rights. You receive only the limited license described in these Terms.

Our store and services may use third-party platforms and providers, including Shopify, payment processors, hosting providers, email services, analytics tools, customer support systems, licensing services, and download delivery systems.

Third-party services are governed by their own terms and privacy policies. We are not responsible for the independent acts, availability, content, or security practices of third parties.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Atomic Boy Audio and its owners, employees, contractors, affiliates, and service providers from claims, damages, liabilities, costs, and expenses arising from your misuse of the products or services, your violation of these Terms, or your violation of another person’s rights.

Suspension and Termination

We may suspend or terminate access to accounts, downloads, activations, licenses, updates, or support if we reasonably believe there has been fraud, payment reversal, license sharing, unauthorized distribution, security abuse, or another violation of these Terms.

Provisions concerning ownership, restrictions, disclaimers, liability, indemnification, and governing law survive termination.

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Any dispute not otherwise resolved by applicable consumer law will be brought in a court of competent jurisdiction located in Florida, unless another location is required by law.

Changes to These Terms

We may update these Terms to reflect changes to our products, services, technology, business practices, service providers, or legal obligations.
